It’s enough to make R.B. Choate Jr. roll over in his recently-dug grave. Choate, a bow-tied Boston Brahmin who died at the age of 84 last week, was a pioneer lobbyist for nutritional foods, testifying before the Senate in 1970 that 40 of the 60 leading breakfast cereals were so low in nutritional content that they constituted “empty calories.†Now, 38 years later, not much has changed. The FDA yesterday issued a warning letter to General Mills, advising the company, as Bloomberg tells it, that advertising for the toasted oats
violates federal law with promises to lower cholesterol and
reduce the risk of heart disease and cancer. The agency told General Mills that the company’s health claims essentially rendered their cereal a drug, and therefore subject to regulation by the FDA. A General Mills spokesperson said the company is looking forward to discussing the problem with the FDA and reaching a resolution.
